Toyota Lemon Law: Warranty, Dispute Program & Your Rights

The short answer

Your state’s lemon law covers a new Toyota. Toyota’s warranty runs 36 months / 36,000 miles basic, and its booklet says you must use the Dispute Settlement Program (run by NCDS) before suing under the federal Magnuson-Moss Act, and may have to before a state lemon law claim.

Toyota owners rarely expect a lemon, so when a Camry, RAV4 or Tacoma keeps returning with the same defect, it can be hard to know where to start. Your state’s lemon law sets the rules for a buyback or replacement.

Toyota’s 2026 Warranty & Maintenance Guides explain the coverage and a dispute step you should not skip. Here is what they say.

How long state lemon laws protect a Toyota

With 36 months / 36,000 miles of basic coverage, your Toyota’s warranty usually outlasts its lemon law window. A two-year state closes the window with 1 year of warranty to go; a one-year state, with 2 years. Repairs in that gap are free, but they rarely count toward a buyback.

Many windows also stop at 12,000 to 24,000 miles, long before the 36,000-mile limit on a Toyota warranty. Find your state’s exact rule in our state guides, or check your Toyota repair history against your state’s window.

Toyota’s dispute program

Toyota lists three steps: talk to a dealership manager, call the Toyota Brand Engagement Center at (800) 331-4331, then use the Dispute Settlement Program, run by the National Center for Dispute Settlement. It is informal and free. To start, mail the claim form from the Owner’s Warranty Rights Notification booklet in your glove box to NCDS, P.O. Box 515284, Dallas, TX 75251-5284, or call NCDS at (800) 777-8119 for a form.

The guide says you must use the program before going to court under the Magnuson-Moss Warranty Act, and you may be required to use it before seeking lemon law remedies in your state. California residents use the California Dispute Settlement Program (CDSP) at (888) 300-6237; Toyota warns that not using it may affect your rights under California’s lemon law.

Things Toyota owners should know

  • Find the Owner’s Warranty Rights Notification booklet in your glove box now. It has the claim form and your state’s requirements.
  • Toyota’s warranty transfers automatically, so a used Toyota bought inside the warranty may still count in states that cover later owners.
  • Lexus, Toyota’s luxury brand, is also an NCDS client and has its own warranty booklet.

What to do if your Toyota is a lemon

  1. Talk to the dealership’s service or customer relations manager and keep a repair order for every visit.
  2. Call the Toyota Brand Engagement Center at (800) 331-4331 with your VIN, mileage and dealer name.
  3. Send written notice, using the address your state requires or Toyota’s warrantor address in Plano; our notice letter generator can help.
  4. Mail the NCDS claim form from your glove-box booklet (or contact the CDSP in California). Toyota says this is required before a Magnuson-Moss lawsuit.
  5. If the result does not resolve it, use your state’s process or court before the deadline.
